THE “TEAC” CONFIRMS THE POSSIBILITY TO RETURN VAT TO FOREIGN COMPANIES

According to a recent administrative decision, it will be possible for foreign companies to obtain VAT return, being compulsory to be heard by the court as opposed to previous decisions.

So these foreign companies will be able to claim whatever they consider in accordance with law in order to accomplish the return.

So that, this decision has ended the unequal treatment that these companies were suffering, discrimination that was against the European Treaties once that the unequal treatment was making difficult to create a global market in the European Union, the right to move and freely reside within the territory of the Member States and was increasing the restrictions on the movement of capital between Member States and between Member States and third countries.
